Terms of Service

By accessing or using the services provided by Otter CyberTech, you agree to be bound by these Terms of Service. Please read them carefully before engaging with our services.
1. Services
Otter CyberTech provides web development, mobile application development, cloud engineering, and cybersecurity services. The scope, timeline, and deliverables of each engagement are defined in a separate project agreement or statement of work signed by both parties.
2. Client Responsibilities
- Provide accurate and complete information required for project execution
- Review and provide timely feedback on deliverables
- Ensure you have the rights to any content, assets, or materials provided to us
- Make payments according to the agreed schedule
- Maintain confidentiality of any credentials or access provided during the project
3. Intellectual Property
Upon full payment, the client receives ownership of all custom code and assets developed specifically for their project. Otter CyberTech retains the right to use general methodologies, frameworks, and tools developed independently.
We reserve the right to display completed work in our portfolio unless explicitly agreed otherwise in writing.
4. Payment Terms
Payment schedules are outlined in individual project agreements. Late payments may result in work being paused until outstanding balances are settled. All fees are non-refundable unless otherwise stated in the project agreement.
5. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the course of the engagement. This obligation survives the termination of the agreement.
6. Limitation of Liability
Otter CyberTech shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the total fees paid for the specific service giving rise to the claim.
7. Termination
Either party may terminate a project engagement with 14 days written notice. The client is responsible for payment of all work completed up to the termination date.
8. Governing Law
These terms are governed by the laws of Nepal. Any disputes shall be resolved through mutual negotiation, and if unresolved, through the appropriate courts of Kathmandu, Nepal.
